Property Settlements

There is no automatic 50–50 split of property when a relationship ends. Where the parties cannot agree how their property should be divided, the court will look at each party’s—

  • financial contributions;
  • non-financial contributions; and
  • future needs;

and decide what percentage of the property each party should receive. The court can then make orders to implement the division of the property, including requiring a person to—

  • pay money;
  • sell or transfer property;
  • split superannuation;
  • sign any document; and
  • make ongoing maintenance payments.

If the parties cannot agree who gets the family home, the court will often order that the home be sold and that the proceeds of the sale be divided as above.

Time Limits for Property

If you were married, you have one year from the date that your divorce is final to apply to the court for a financial order.

If you were in a de facto relationship, you have two years from the date that your de facto relationship ended to apply to the court for a financial order.
